OH & S - Occupational Health & Safety

the Occupational Health and Safety Regulation 2001.

you know that:
The OH
& S Act and Regulations don't cover just the Workplace - they also cover
individuals and corporations.
THE INDIVIDUAL:
An individual who employs
tradespeople, for whatever reason, is required to exercise a duty of care
to ensure that those tradespeople are not placed in circumstances that are
hazardous and that may lead
to injury or death within the premises where tradespeople work.
A CORPORATION:
Corporations are required
to exercise the same duty of care in the place of work where
they may employ tradespeople to carryout work for them, or where they themselves
employ workmen.
Strata Plan and/or
Community Title Properties, (including Lots and Common Property), are considered
to be a place
of work under the NSW OH & S Act 2000. This applies regardless of whether a
Strata or Community Scheme employs contractors on its behalf or has work carried
out by its own employees.
Executive Committees for
Strata Plans, and Community Title Properties should be aware of their duty of
care and responsibilities under the new Act and Regulation.
ACT AND REGULATION:
The OH & S Act sets out requirements for ensuring that
workplaces are safe and healthy.
These requirements spell out the duty of care of
different groups who play a role in workplace health and safety.

The NSW Occupational Health and Safety Act 2000
aims to protect the health and safety and welfare of people at work. The lays
down general requirements that must be met at all places of work in New South
Wales.
The OH
& S Regulation 2001 aims to support the Act in achieving reductions in the
incidence of workplace death, injuries and disease.
The ACT defines the
following:
"occupier"
of premises includes:
-
a person who for the
time being, has (or appears to have) the charge, management or control of
the premise, or
-
a person who, for the
time being, is in charge (or appears to be in charge) of any operation being
conducted on the premises.
"premises"
includes any place and in particular includes:
-
any land, building or
part of any building, or
-
any vehicle, vessel or
aircraft, or
-
any installation on
land, on the bed of any waters or floating on any waters, or
-
any tent or moveable
structure (including common property) and covers any land, building or part
of any building.
"controller of
premises" means a person who has control of premises used by people as a
place of work including:
-
a person who has only
limited control of the premises, and
-
a person who has, under
any contract or lease, an obligation to maintain or repair the premises.
The REGULATION defines
the following:
"work"
means work as an employee or as a self employed person.
"place of
work" means premises where persons work.
"employer"
means a person who employs persons under contracts of employment or
apprenticeship.
"employee"
means an individual who works under a contract of employment or apprenticeship.
PENALTIES:
-
Under OH & S an Owners Corporation can be fined up to $
550,000.00, and individual $ 55,000.00 and/or face 2 years in jail for breaches
of the Act or Regulation.
